Do I Need Patient Consent to Use Kubo’s AI Scribe?

Learn what patient consent is required when using Kubo’s AI Scribe, including legal considerations, consent options (written or verbal).

Updated over 7 months ago

Kubo’s AI Scribe is built to support dental surgeons by streamlining documentation through real-time transcription of clinical conversations. You decide how and when to use Kubo—and you are responsible for complying with local laws on patient consent and privacy.

Consent Requirements Depend on Your Location

Recording laws vary significantly between U.S. states and Canadian provinces. Some jurisdictions require all parties to consent (“two-party consent”), while others only require one-party consent.

This means:

  • In some areas, explicit patient consent may be legally required.

  • In others, obtaining consent may not be mandatory but remains a recommended best practice.

⚠️ You are responsible for ensuring that your use of Kubo complies with all applicable laws and regulations.

What Type of Consent Is Needed?

You typically have two options:

1. Written Consent

  • Can be included in patient intake or treatment consent forms.

  • Provides clear, auditable documentation of agreement.

Example:

“I consent to the use of audio technology, including AI transcription tools, during my visits to support accurate medical documentation.”

2. Verbal Consent

  • Can be obtained at the start of each appointment.

  • Should be documented in the clinical note.

  • Many customers choose to explain the technology briefly and confirm the patient is comfortable proceeding.

Example:

“I use a secure AI tool to help take notes during our visit. It listens to our conversation and generates a clinical summary. Is that okay with you?”

Who Is Responsible for Obtaining Consent?

You are. As the provider, you determine when Kubo is used and are responsible for informing patients and obtaining appropriate consent.

Kubo does not not assume responsibility for local compliance. We give you the tools—you control the use.

Best Practices for Using AI Responsibly

  • Understand your local regulations—consult legal or compliance teams if needed.

  • Be transparent—clearly explain to patients how Kubo is used to support their care.
